We respect your privacy. This policy explains what we collect, why, how we use/share it, and your choices. If you buy a program, your MSA/SOW/Exhibits govern that purchase; this policy explains our data practices across our website, community, and coaching operations.

What we collect

  • Identity/Contact: name, email, phone, mailing address, account handles.

  • Payment: last‑4, billing info (processed by Stripe/PayPal; we don’t store full card numbers).

  • Coaching Data: training metrics, files, and notes from TrainingPeaks, Strava, WKO5 (e.g., HR, power, GPS), goals, event dates, schedule constraints.

  • Communications: emails, texts, WhatsApp/iMessage, Instagram/Facebook DMs, support tickets.

  • Community Content: posts, comments, profiles inside Circle.

  • Device/Usage: IP, device/browser info, pages viewed, timestamps (via Squarespace analytics and similar).

  • E‑sign: signature, audit logs (PandaDoc).

  • Scheduling: availability and appointment info (Calendly).

How we use data (purposes + legal bases)

  • Provide coaching services and community access (contract).

  • Personalize plans, analyze progress, and support you (contract/legitimate interests).

  • Process payments, send receipts, manage accounts (contract/legal obligation).

  • Communicate service updates and onboarding (contract/legitimate interests).

  • Marketing (with consent where required): newsletters, launches, and educational content. You can opt out anytime.

  • Security, fraud prevention, and legal compliance (legitimate interests/legal obligation).

Sharing

We share data with service providers who help us operate, under agreements that limit their use to our instructions:

  • Payments: Stripe, PayPal

  • Website/Analytics: Squarespace (incl. Squarespace Analytics)

  • Community: Circle

  • Coaching: TrainingPeaks, Strava, WKO5

  • E‑sign: PandaDoc

  • Scheduling: Calendly

  • Communications/Support: Gmail; limited use of WhatsApp/iMessage; Instagram/Facebook for DMs you initiate We don’t sell or “share” personal information for cross‑context behavioral advertising.

International transfers

We operate in the U.S. and may transfer data internationally. For EU/UK residents, we rely on appropriate safeguards (e.g., SCCs) with our processors where required.

Retention

We keep data while your account is active and for up to 24 months of inactivity, or longer if needed for legal, accounting, or security purposes. We’ll delete or anonymize when no longer needed

Your rights

  • General: access, correct, delete, and portability (where applicable). Object/restrict certain processing.

  • EU/UK (GDPR/UK GDPR): you can withdraw consent, object to legitimate interests, request copies (data portability), and complain to your local authority. Our primary contact is below.

  • California/US state laws: access, delete, correct, and non‑discrimination rights. We do not sell/share your personal info. You can opt out of marketing anytime. To exercise rights: email colewis.capacitycoaching@gmail.com. We’ll verify your request and respond within legal timelines.

Cookies & tracking

We use Squarespace analytics and similar technologies to run and improve the site. A cookie banner and detailed Cookie Notice will be posted when available. You can manage cookies in your browser. Blocking some cookies may impact site function.

Marketing choices

  • Email/SMS: only if you opt in (e.g., lead magnet forms). Unsubscribe or reply STOP to opt out.

  • Community/Testimonials: you can request removal of your posts/testimonials; we’ll honor within a reasonable time.

Security

We use SSL, access controls, and vendor‑provided encryption at rest where supported. No online system is 100% secure; please use strong passwords and protect your devices.

Children

Our services are for adults and 16–17‑year‑olds with parental consent. We don’t knowingly collect data from children under 16. If we learn we have, we’ll delete it.

Third‑party links

We may link to third‑party sites. Their privacy practices are their own—review their policies.

Changes

We may update this policy. We’ll post the new effective date. Material changes will be highlighted. Continued use means you accept the updated policy.
