Terms of Service
Effective Date: June 26, 2026
By accessing www.capacity-coaching.com (the “Site”), joining our community, or purchasing any product or service, you agree to these Terms of Service (“Terms”). If you purchase a program, your Master Services Agreement (MSA), Statement of Work (SOW), and any Guarantee Exhibit govern that purchase and control in case of conflict with this Site TOS.
1) Who we are

2) Eligibility
Global audience; English language.
16+ only. If 16–17, you confirm parental/guardian consent. No use by children under 16.
3) Not medical advice
We provide educational coaching. We are not physicians, dietitians, or therapists. Nothing on the Site or in our programs is medical advice. Consult your doctor before changing training, diet, or lifestyle. You assume all training risks.
4) Accounts & conduct
You must provide accurate info and keep credentials secure. You’re responsible for all activity under your account.
No harassment, spam, illegal, infringing, or harmful content. We may suspend/terminate access for violations.
5) Community rules
Follow posted community guidelines. We may moderate, remove content, or revoke access for violations without refund where permitted by your SOW/MSA.
6) User content & testimonials
You own what you post. You grant us a worldwide, royalty‑free, revocable license to host, display, and share your posts/testimonials for Site/community operation and promotion. You can request removal via support email (reasonable time to process).
If you submit testimonials, race photos, or results via the Site, you grant permission to use them with opt‑out available on request.
7) IP and license
All Site materials, plans, and content are our IP or licensed to us. When you purchase, you receive a personal, non‑transferable license for your own use. No sharing, reselling, or redistribution.
8) Commerce (Stripe checkout)
Currency: USD. Taxes: collected by Stripe where applicable.
Pricing and inclusions are shown on the checkout page and in your SOW. We may update prices anytime before purchase.
Refunds: all sales are final except explicit performance guarantees stated in your SOW Exhibits (if any). PIF‑only guarantees are version‑locked at purchase and are the sole remedy, per the Exhibit.
Payments: if a payment fails, we may retry up to three (3) times over seven (7) days; services may pause for non‑payment. Chargebacks are a breach; you’re responsible for related bank/collections/legal costs where permitted.
If any conflict arises, the signed MSA/SOW/Exhibits for your purchase control.
9) Privacy, cookies, and marketing
We use cookies/analytics (e.g., GA/Meta Pixel) to operate and improve the Site. A Cookie Notice and Privacy Policy will be posted and govern data use once live; check back for updates.
Email/SMS marketing: we only send if you explicitly opt in (e.g., lead magnet forms). You can opt out anytime via unsubscribe/STOP. Message/data rates may apply.
10) Disclaimers
The Site and content are provided “as is” and “as available” without warranties of any kind. We don’t guarantee specific results from Site use.
11) Limitation of liability
To the maximum extent allowed by law, our total liability for claims arising from the Site or purchases is capped at the fees you paid to us for the applicable product/service giving rise to the claim. No indirect, incidental, special, consequential, or punitive damages.
12) Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising out of your Site or program use, your content, or your violation of these Terms.
13) Termination
We may suspend or terminate access for any violation. Your obligations (IP, payments owed, indemnity, limitations) survive termination.
14) Changes to Terms
We may update these Terms anytime by posting a revised version with a new effective date. Your continued use after changes means acceptance. For purchases, the version attached to your SOW/Exhibits at purchase controls that transaction.
15) Governing law & venue
California law governs. Exclusive venue and jurisdiction: state and federal courts located in California, USA.

17) Guarantee (summary, click to see full terms below)
Some offers include a performance guarantee for Paid‑In‑Full buyers only. Installments typically do not qualify. Details, metrics, compliance, and remedy are defined in the relevant Exhibit delivered post‑purchase; that Exhibit controls. Clear, strong guarantees exist to reduce buyer risk; their conditions limit abuse.

Faster Than Wheels Guarantee:
Beat $2,000 wheels in 12 weeks or we buy them for you. Do 95% of your custom cycling plan, and if you’re not at least “wheel‑fast” on our tests, we’ll refund 100% and send you $2,000 for gear. You win either way. Yes, seriously. We’re that confident in what we deliver. Best case? You crush your goals. Worst case? You get a free training plan and $2,000 to upgrade your gear. No risk. All upside.
“Wheel‑fast” = clear gains on standardized cycling tests (not raw mph). We baseline in Week 1, re‑test in Weeks 4, 8, and 12.
Who qualifies
Serious cyclists only. Only applies to Client's first Peak Capacity 12‑week plan that is paid in full, as stated on the applicable order form, invoice, or checkout page.
Not for pros, unless Coach approves in writing.
Post‑program community rollover products under Section 6 and any ongoing every‑4‑weeks coaching renewals under Section 7 after the first 12‑week plan are not covered.
No pauses/cancellations/chargebacks during the 12‑week guarantee period. Late or failed payments, pauses, or chargebacks void eligibility.
Required devices
Working heart‑rate monitor and cycling power meter.
Client maintains access to TrainingPeaks (and Strava where used) and uploads ride data with heart‑rate and power (and GPS where available).
What “measurably faster” means (any ONE qualifies)
FTP: +5% OR +0.25 W/kg vs. Week‑1 baseline (same protocol/device/setup).
Time trial: −2% time on a matched 20–40 min flat or rolling loop (same route/position/tires & pressure; comparable weather).
Matched workout efficiency: same NP with ≥3 bpm lower avg HR, or +3% NP at same avg HR (±3 bpm).
Compliance (95% to qualify)
For this guarantee, “do 95% of your custom cycling plan” means completing the required tests and the minimum number of KEY workouts below.
KEY workouts: Each training week, Coach will designate up to three (3) KEY workouts in TrainingPeaks (plus any formal test sessions). KEY workouts will be clearly identified either (a) in messaging between Coach and Client and/or (b) directly on the TrainingPeaks calendar, for example by adding asterisks in the workout title such as ***[Workout Name]*** or by labeling the workout as “KEY” in the title or description. Recovery rides and non‑KEY endurance sessions do not count toward the KEY‑workout requirement.
Tests: Client completes baseline + Week 4, 8, and 12 tests (same device/route or indoors for apples‑to‑apples).
Minimum completion: Over 12 weeks, Client completes at least thirty‑three (33) of thirty‑six (36) scheduled KEY workouts, plus all scheduled test sessions. This is what “95% of your plan” means for this guarantee.
“As prescribed”: A KEY workout is considered completed if done within ±10% of the prescribed duration and within the target intensity ranges (for example, power or heart‑rate zones) shown in TrainingPeaks.
Uploading data: Upload every completed ride to TrainingPeaks the same day (HR + power; GPS where available). Unlogged rides do not count toward compliance.
Plan edits and late changes: Plan edits must be coach‑approved in advance. If Client requests a change to a future KEY workout at least forty‑eight (48) business hours before its original scheduled start time and Coach updates the plan, only the revised KEY workout counts for compliance (the original version does not count as a miss). If Client misses or does not complete a KEY workout and either does not request a change, or requests it inside the forty‑eight (48) business‑hour window, that KEY workout counts as a miss for guarantee purposes.
Support if progress stalls: If a Week 4 or Week 8 re‑test shows no improvement by our “wheel‑fast” criteria and Client is ≥95% compliant to that point, Client must, within 7 days, either (1) attend one live Q&A, (2) make a forum/community post seeking guidance, or (3) request a brief plan tune‑up via email or DM to keep the guarantee active.
Compliance Notes for Clarity:
“No improvement” = you don’t hit any “wheel‑fast” thresholds at that checkpoint (e.g., +5% FTP, −2% TT time, or +3% NP at same HR).
Screenshot Q&A attendance as proof. Forum posts & tune‑up requests are timestamped/logged in your community account or email as proof.
Exclusions
Injury/illness preventing training/tests.
Missed check‑ins; ignoring coach guidance.
Device failure/corrupted/missing data; unlogged sessions.
Major equipment/fit changes mid‑block that invalidate comparisons (e.g., aero position change) unless we re‑baseline.
Non‑payment/chargebacks; breach of the MSA or SOW.
How to claim
Email your coach or support within 7 days of Week 12 completion requesting a guarantee review.
Provide TrainingPeaks access + any requested device IDs or data.
Review within 14 business days; we share the data‑based decision in writing.
Remedy
Approved claims: 100% refund of the Program Fee to the original payment method + $2,000 gear stipend via ACH within 14 business days (may require W‑9/1099 or similar where applicable). One claim per customer.
Legal
Governed by California law. Terms version‑locked at purchase. This guarantee is the sole remedy and is contingent on full payment and compliance.
